The Philippine Toxic Substances and Hazardous Nuclear Waste Control Act (R.A.6969) was promulgated and implemented in 1990. Chapter II of Part 8 of the Act and its Implementing Rules (DAO 1992-29) requires Philippine producers and importers to file a Pre-production Pre-Import Declaration (PMPIN) for new chemical substances with the Philippine Department of Environment and Natural Resources (DENR) 90-180 days prior to the production and importation of new chemical substances.

2, Scope of application:A new chemical substance or a composition containing a new chemical substance, where a new chemical substance means a chemical substance first produced or imported in the Philippines after December 31, 1993 and not included in the Existing List of Chemical Substances in the Philippines (PICCS).
3. PMPIN exemption:
• Formulations without new chemical ingredients
• Natural substances (unprocessed, or processed only by hand, mechanical, gravity, water extraction, flotation, heating dehydration, or extracted from the air by any means, including natural agricultural products, water, air, natural gas, mineral oil, rocks, ores and minerals)
• Other regulated manufactured products (radioactive substances, pesticides, pharmaceuticals, food, cosmetics)
• By-product
• Non-separated intermediate
• Annual production/import less than 1 t/a
• Polymers that meet specific requirements
4. Compliance obligations of enterprises
Pre-production pre-import declaration PMPIN: PMPIN declaration is divided into two forms: Abbreviated Form and Detailed Form, of which Abbreviated Form applies to new chemical substances that have been listed in the chemical substances list of the United States, the European Union, Australia, Japan, Canada or South Korea, but not included in PICCS; Otherwise, PMPIN Detailed Form and test report of required data need to be submitted. After approval, DENR-EMB issues a PMPIN certificate to the applicant, who is required to submit a Notice of Commencement (NOC) when first producing or importing. One year after the NOC completes the submission, the declared substance will be included in the PICCS.
Small import license SQI: When the annual production/import of new chemical substances is less than 1 t/a, the submission of SQI declaration can be exempted from PMPIN after approval, and the information requirements are the application form and SDS. After the SQI is approved, DENR-EMB issues the SQI license to the applicant, and the SQI certificate is valid for the following two dates: 1 year or the annual production/import of the declared substance reaches 1 t. The SQI certificate can be renewed after one year, and the same applicant can renew the same substance up to 5 times.
