Legal overview
On April 9, 2021, the State Food and Drug Administration issued an announcement (No. 51 of 2021) on the Technical Guidelines for Cosmetic Safety Assessment (2021 Edition). The Technical Guidelines will enter into force on 1 May 2021. Since January 1, 2022, before applying for the registration of special cosmetics or the filing of ordinary cosmetics, cosmetic registrants and recordholders must carry out cosmetic safety assessments and submit product safety assessment data in accordance with the requirements of the Technical Guidelines. Before May 1, 2024, cosmetics registrants and registrants can submit simplified product safety assessment reports in accordance with the relevant requirements of the Technical Guidelines.
Cosmetics registrants and recordholders shall carry out safety assessment by themselves or entrust professional institutions to form safety assessment reports, and be responsible for their authenticity and scientificity. The safety assessment data of cosmetics shall be updated in a timely manner as required, and the retention period shall not be less than 10 years after the end of the shelf life of the last batch of products on the market.
Requirements for Cosmetic Safety Assessors
1, with medical, pharmaceutical, biological, chemical or toxicology related knowledge of cosmetic quality and safety, understand the production process of cosmetic products or raw materials and quality safety control requirements, and have more than 5 years of related professional experience.
2. Able to consult and analyze chemical, toxicological and other relevant literature information, analyze, evaluate and interpret relevant data.
3, can fairly and objectively analyze the safety of cosmetics, carry out safety assessment work on the basis of comprehensive analysis of all available data and exposure conditions, and be responsible for the scientific, accuracy, authenticity and reliability of the assessment report.
4. Can learn relevant knowledge of safety assessment, understand and master new theories, technologies and methods of safety assessment, and apply them into practice by receiving corresponding professional training regularly.
