A, regulatory background
 
In Thailand, new foods are classified as specially regulated foods and require approval from the Thai Food and Drug Administration (TFDA) before they can be legally marketed in Thailand. In accordance with the provisions of Article 5 (1) and paragraphs 6(3), (9) and (10) of the Food Act B.E.2522 (1979), the Ministry of Public Health of Thailand has issued Bulletin No. 376, i.e. B.E.2559 (2016) Re: Novel Food. It clearly stipulates the definition of Novel Food, application for safety assessment and its management department, quality standards, use methods, maximum allowable consumption, labeling and so on. The same regulation applies to imported new types of food.
 
According to the definition of B.E.2559 (2016) Re: Novel Food, one of the following conditions must be met:
1) Any substance used as a food or as an ingredient in food that has been consumed in Thailand for no more than 15 years.
2) Any substance used as a food or food ingredient that uses a new production process that is not currently widely used and that causes a material change in the composition or structure of the food that affects its nutritional value, metabolism, or the content of undesirable substances.
3) food containing 1) or 2) above as an ingredient.
 
B, applicant qualification
 
The applicant shall be a Thai company.
 
C, application process and cycle
 
The application period is usually 1-3 years from data preparation to application completion.
 
*TFDA approved safety assessment institutions, currently only 4 approved institutions designated, These include the Institute of Medicine of the Ministry of Public Health of Thailand's Food Quality and Safety Authority, the Food Research Institute of the Ministry of Industry of Thailand, the Thai National Risk Assessment Center (TRAC), and the Thai National Genetic Engineering and Biotechnology Center (BIOTEC) (for obtaining new foods from genetically modified microorganisms only, without any residual microorganisms and genetic material). Different assessment agencies have different cycles.
